This Services Agreement (the “Agreement”) contains the complete terms and conditions which govern your use of Web hosting, Domain Registrations, e-commerce, Dedicated Servers, and other services provided by EMAILA (the “Services”). In this Agreement, “EMAILA Pakistan”, “EMAILA”, “we”, “us” means EMAILA Pakistan and “Client”, “Subscriber”, “you”, or “your” means you. By clicking on the “Submit Order” button, or by buying any of our hosting package, you acknowledge that you have read the Agreement, and you agree to its terms, conditions and all policies of EMAILA. Failure to comply with these terms and conditions may result in account suspension or termination, the determination made at the sole discretion of EMAILA, on a case-to-case basis.
In addition to the following, the Acceptable Use Policies provide more detailed information regarding what is acceptable use of our products and services.

EMAILA Pakistan strives to ensure the domain Registrants and Resellers need are always fulfilled. You can view this page to read the ICANN’s directions and policies on your rights and responsibilities as Registrant of domain.
UCE (Unsolicited Commerce Email) – SPAM Policy
Spamming is the sending of unsolicited e-mail, to persons the sender does not know or have prior consent to send the message to. We have a very strict spam protection policy. This also includes sending unsolicited advertisements to newsgroups, email addresses and/or generating a high volume of outgoing email. There are many ways that someone can hide their identity on the Internet, and we are aware of these ways, so be assured that your account would not be terminated until we are not fully sure that they have indeed abused our services. Sending mails through script should always be less than 500 in an hour, consistant violation of this limit will result in account suspension. Also you should script your emails to be sent in intervals of at-least 7 to 10 seconds apart so there is not undue load on the server. Any account found in violation of this will be cancelled immediately.
Please report any instances of spamming to abuse@EMAILA.com, with as much details as possible, by clearly identifying the source of the spam email account.
Disk Space Abuse
The space we provide for hosting should not be used as a storage medium for your files or data. At least 90% of your web pages must be ‘linked’ with files (GIF, JPEG, etc.) stored on EMAILA servers. Website that are found to contain either/or no HTML documents, a large number of unlinked files are subject to files deletion or account cancelation.
An inode is a data structure used to keep information about a file on your hosting account. The number of inodes indicates the number of files and folders you have. This includes everything on your account, emails, files, folders, anything you store on the server.
If an account exceeds one hundred and fifty thousand (150,000) inodes it will be automatically removed from our courtesy backup system to avoid over-usage. The use of more than two hundred and fifty thousand (250,000) inodes on any shared or reseller account prevents user from writing data to disk, and if no action is taken to reduce the excessive use of inodes, your account may be suspended.
Account Resources Abuse
Continuous overuse of server resources may also result in account suspension / termination. Any account using 25% CPU / Memory resources for more than 60 seconds, resulting from the single or combined use of FTP, CGI Scripts, HTML or MySql resources will result in account suspension.
Technical Support Boundaries
EMAILA provides technical support for you that encompasses within our area of expertise only. Such expertise includes assistance, installation, troubleshooting, and debugging, and any other hosting related issues. However, in under no circumstances is EMAILA neither obligated to help you in providing assistance for any coding related issues, errors produced by any applications, unless our support team in its sole discretion is willing to do so.
Disclosure to Law Enforcement
Our acceptable usage policy specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that the EMAILA can disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the client. In addition EMAILA shall have the right to terminate all service set forth.
Legal Threats & Non-professional Behavior
We at EMAILA are here to help you and provide the best possible service. However any unreasonable threats, either personal or against EMAILA will receive a warning for breach of these conditions. Personal abuse towards EMAILA employees or legal threats against the company are viewed as extremely serious. EMAILA reserves the right to refuse to do business with a person or company as a result and possibly terminate any accounts in question.
Changes to the Agreement or the Services
EMAILA may modify, add, or delete portions of this Agreement at any time. If we have made significant changes to this Agreement, we will indicate it at the top of this Agreement with the date of the last revision and a link to previous terms for up to 30 days. Any revisions to this Agreement will become effective when posted unless otherwise specified. You agree to any modification to this Agreement by continuing to use the Services after the effective date of any such modification.
EMAILA reserves the right to modify, change, or discontinue any aspect of the Services at any time.
Backups and Data Loss
Your use of the Services is at your sole risk. EMAILA is not responsible for files, data residing on your account. YOU AGREE TO TAKE FULL RESPONSIBILITY FOR FILES AND DATA TRANSFERRED AND TO MAINTAIN ALL APPROPRIATE LOCAL BACKUPS OF FILES AND DATA STORED ON EMAILA SERVERS.
EMAILA’s backup service runs once a week and overwrites any of our previous backups. Only one week of backups are kept at a time. This service is provided only to shared and reseller accounts as a courtesy and may be modified or terminated at any time at EMAILA’s sole discretion. EMAILA does not maintain backups of dedicated or vps accounts unless a backup service is purchased as addon.
Any shared account using more than 20 GBs of disk space will be removed from our weekly backups.
Disclaimer of Warranty
EMAILA INTERNET SERVICE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES AND ALL TEXT, GRAPHICS, LINKS ARE PROVIDED TO CLIENT ON AN ‘AS IS, AS AVAILABLE’ BASIS AND WITHOUT WARRANTY OF ANY KIND. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO EMAILA OR ANY INFORMATION OR SOFTWARE THEREIN.
Limitation of Liability
YOU RELEASE EMAILA FROM ANY LIABILITY OR RESPONSIBILITY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGE SUFFERED BY YOU RELATED TO YOUR USE OF OR INABILITY TO USE EMAILA SERVICES INCLUDING, BUT NOT LIMITED TO, DAMAGE FROM LOSS OF DATA RESULTING FROM DELAYS, SERVICE INTERRUPTIONS, MISS-DELIVERIES, NON-DELIVERIES, OR DUE TO INADVERTENT RELEASE OR DISCLOSURE OF INFORMATION SENT BY YOU EVEN IF THE SAME IS CAUSED BY EMAILA’s OWN NEGLIGENCE.
